What Is a PEP Check? Definition, Scope, and What Banks Actually Do

What a PEP check is

A PEP check is the process of determining whether a customer, beneficial owner or signer is a politically exposed person: someone entrusted with a prominent public function, or a family member or close associate of one. It combines a name-and-identifier screen against PEP data with human adjudication of matches, classification by PEP type, and a risk decision on what due diligence follows.

The definition sounds settled. It is not. Three regimes define the term differently, and the differences decide who lands in your queue.

Three definitions: FATF, the United States, the EU

FATF

FATF's 2013 guidance splits PEPs into foreign, domestic and international-organisation PEPs. Foreign PEPs are always higher risk. Domestic and international-organisation PEPs are assessed on a risk basis. Family members are "individuals who are related to a PEP either directly (consanguinity) or through marriage or similar (civil) forms of partnership"; close associates are "individuals who are closely connected to a PEP, either socially or professionally".

The enhanced measures FATF lists are senior management approval of the relationship, reasonable measures to establish source of wealth and source of funds, and enhanced ongoing monitoring.

United States

The Bank Secrecy Act regulations never use the term PEP. The defined term, in 31 CFR 1010.605(p), is "senior foreign political figure": a current or former senior official of a foreign government's executive, legislative, administrative, military or judicial branch, a senior official of a major foreign political party, or a senior executive of a foreign government-owned commercial enterprise. The definition also covers any entity formed by or for the benefit of such a person, immediate family (spouses, parents, siblings, children and a spouse's parents and siblings), and anyone widely and publicly known to be a close associate.

The only mandatory duty attached to that term sits in 31 CFR 1010.620. For private banking accounts held by non-US persons, a covered institution must take reasonable steps to ascertain whether any nominal or beneficial owner is a senior foreign political figure and, if so, apply enhanced scrutiny designed to detect transactions that may involve the proceeds of foreign corruption.

Everything else is risk-based. The 2020 interagency statement from the Federal Reserve, FDIC, FinCEN, NCUA and OCC said the agencies "do not interpret the term 'politically exposed persons' to include U.S. public officials", and went further:

There is no regulatory requirement in the CDD rule, nor is there a supervisory expectation, for banks to have unique, additional due diligence steps for PEPs. The CDD rule also does not require a bank to screen for or otherwise determine whether a customer or beneficial owner of a legal entity customer may be considered a PEP.

European Union

The EU takes the opposite approach and enumerates the functions. The Fourth AML Directive defines a PEP as a natural person "who is or who has been entrusted with prominent public functions" and lists heads of state and government, ministers, members of parliament, governing bodies of political parties, supreme and constitutional court judges, courts of auditors and central bank boards, ambassadors and high-ranking military officers, boards of state-owned enterprises, and directors and board members of international organisations. Domestic officials are included. The directive adds that no listed function "shall be understood as covering middle-ranking or more junior officials".

Close associates under the directive are people with joint beneficial ownership or other close business relations with a PEP, or sole owners of a vehicle set up for a PEP's de facto benefit. The directive also sets a floor of at least twelve months of continued PEP treatment after a person leaves office, after which the approach becomes risk-based.

What a PEP check consists of in practice

Collect identifiers at onboarding. Full name, date of birth, nationality, country of residence and, for legal entities, beneficial owners and controllers. The US definition reaches entities formed for a senior foreign political figure's benefit, so the KYB layer matters as much as the individual screen.

Classify. Foreign, domestic or international organisation; primary PEP, family member or close associate; current or former. Each combination maps to a different risk treatment.

What US banks actually do, and the tiering decision

Despite the 2020 statement, almost every US bank screens for PEPs. Section 312 requires the senior foreign political figure determination for private banking; vendor screening bundles PEP data with sanctions lists; and FinCEN's 2022 kleptocracy advisory expects "reasonable steps to ascertain the status of an individual as a senior foreign political figure" as part of risk-based controls. Turning the PEP list off is not a realistic option.

The real design decision is which tiers to switch on for which customer segments. In our experience the bulk of PEP alert volume comes from domestic-official and close-associate categories, not from foreign heads of state. Since the agencies do not treat US officials as PEPs, screening every mayor and state legislator against a retail deposit book produces alerts with no regulatory anchor behind them. A defensible configuration runs foreign PEP and senior foreign political figure tiers across all customers, and adds domestic and associate tiers for private banking, high-value, cross-border and legal-entity customers with foreign beneficial owners. Write that down as a risk-based decision and cite the 2020 statement. Examiners accept documented risk-based choices. They do not accept undocumented ones.

FAQ

Is a PEP check mandatory in the US?

Not under the CDD rule, according to the 2020 interagency statement. It is mandatory in one place: private banking accounts for non-US persons, where 31 CFR 1010.620 requires the institution to ascertain whether an owner is a senior foreign political figure and apply enhanced scrutiny.

Are US politicians PEPs?

Not in the regulators' reading. The agencies said they do not interpret the term to include US public officials. Many banks screen domestic officials anyway as a policy choice, which is fine as long as the policy says why.

How long does someone stay a PEP?

FATF says the handling of a former PEP "should be based on an assessment of risk and not on prescribed time limits". The EU sets a floor of at least twelve months. The US definition covers "current or former" senior foreign political figures with no time limit stated.
